What is FSSAI?

The Food Safety and Standards Authority of India (FSSAI) is a legal authority that offers a food license to all food business operators (FBO) in India. It ensures the food products undergo quality checks thereby curtailing the food adulteration and sale of sub-standard products. It is responsible for the registering and licensing of the Food Business Operators (FBO) in India and it lays down the rules and regulation for running the food business in India.

FSSAI license and FSSAI registration:

Sometimes people are confused about this as they do not know the difference between FSSAI Registration and FSSAI License.

FSSAI Registration: FSSAI registration is required for a category of food business which is called petty food business. Petty food business or petty food operator is defined as an FBO who is a manufacturer or sells any article of food himself as a petty retailer, hawker, itinerant vendor or temporary stallholder. If an FBO distributes foods in any religious or social gathering and the turnover does not exceed Rs 12 lakhs. FBOs in this category are required to obtain an FSSAI registration by submitting an application for registration in Form A. FSSAI registration certificate contains the registration number and a photo of the applicant. FBO has to display this certificate at the place of food business at all times while carrying on the food business.

FSSAI LICENSE: Any person or company which cannot be categorized as a petty food business operator is required to obtain an FSSAI license for operating a food business in India. An applicant can apply for an FSSAI license which is of two types, State FSSAI License and Central FSSAI License. Based on the annual turnover and presence in one or more states, FBOs need to apply for State or Central License. Any large food business which is manufacturing, processing, transporting and importing food products require central FSSAI license while medium-sized food manufacturers, processor, and transporters need a State License. The fee and process of obtaining an FSSAI license is more complex than securing an FSSAI registration. FSSAI license application is made in Form B while for FSSAI registration, the applicant is required to fill Form A.

 

Eligibility for applying for an FSSAI registration:

Suppliers	The yearly turnover of up to Rs.12 lakhs
Dhaba owners	Rs.12 lakhs turnover per annum
Clubs/Canteen	Rs.12 lakhs turnover per annum
Hotels/Restaurant	Rs.12 lakhs turnover per annum
Transporters	Rs.12 lakhs turnover per annum

2.      Plan of the processing unit showing the dimensions and operation-wise area allocation

3.      List of Directors/ Partners/ Proprietor with address, contact details, and photo ID

4.      Name and list of equipment and machinery used with the number and installed capacity

5.      List of food category to be manufactured

6.      Authority letter from manufacturer nominated a responsible person name and address

7.      Analysis report of water to be used in the process to confirm the portability

8.      Proof of possession of premises- Electricity Bill (latest)

9.      Rent Agreement, if applicable

10.  Property Tax Bill of Business premises

·         PAN of the Business (Partnership / Private Limited Company / LLP)

·         MOA /AOA of Private Limited Company and LLP Agreement of LLP

·         Certificate of Incorporation of LLP / Private Limited Company

·         Partnership deed

·         Plan of the processing unit showing the dimensions and operation-wise area allocation

·         Name and list of equipment and machinery used for manufacturing along with Quantity, details of Horse Power and Production Capacity

·         Photographs of Machinery and Lab Instruments

·         List of food category to be manufactured

·         List of products along with ingredient and additives list to be manufactured

·         Authority letter from manufacturer nominated a responsible person name and address

·         BIS Certificate (Required for Packaged Drinking Water only)

·         Source of raw material for milk, meat etc (only required for Milk/ meat unit)

·         Ministry of Commerce Certificate for 100% EOU

·         IE code document issued by DGFT

·         Certificate from Ministry of Tourism

·         Proof of possession of premises- Electricity Bill (latest)

·         Index Copy (if the applicant id the owner of the place)

·         Rent Agreement, if applicable

·         Property Tax Bill of Business premises

·         Blueprint of the area (Layout Plan)

·         FSSAI License Certificate of Manufacturer along with NOC copy (required for Re-Packer)

·         Shop & Establishment Certificate with Professional Tax Certificate

·         Balance Sheet and P&L Statement of Financial Year (For Wholesaler/Retailer/ Supplier/Distributor KOB)

·         NOC and copy of License from the manufacturer

·         Food safety management system plan or certificate

·         NOC from the municipality or local body

·         CGWA NOC if the water is been used from bore-well, if not than an undertaking of water supply along with valid proof (If the units are situated within the limits of Gandhinagar, Kalol, Mansa and Mehsana)

·         Supporting document for proof of turnover and transportation

·         Analysis report of water to be used in the process to confirm the portability.
